This area of law encompasses the myriad issues which can arise after someone dies. We assist our clients in preparing and filing applications for Probate or for Administration of estates.

Estates With or Without a Will

Usually people with substantial estates have provided directions or made arrangements for the distribution of their estate, whether by a will or by an inter vivos (during their lifetime) gift or trust.

However, this is not always the case. When people die without leaving a will, or with a will which is found to be invalid for any reason, the law specifies how the estate is to be distributed. We provide advice to administrators, and act as counsel when necessary, in dealing with those situations.

Common Probate and Estate Administration Issues

Even when a deceased person has left a valid will, a number of issues may arise. Some beneficiaries may feel that someone unduly pressured or influenced the Testator to do what she did. Spouses or children who feel they have not been adequately provided for may apply to Court for a variation of the will. Sometimes matters of interpretation of terms of the will must be deal with by a Judge.
